General terms and conditions of Agrisan GmbH


Your right of return:

According to the law, we are obliged to inform you about your right of return before making a purchase. This right only applies to private consumers, i.e. every natural person who concludes a legal transaction for a purpose that cannot be attributed to commercial or independent professional activity.
The contract is legally concluded when an order confirmation is sent on a permanent data carrier (by e-mail or post).
We ask you to understand these consumer protection provisions in terms of a mutual partnership.
Right of withdrawal from the contract: Buyers who are consumers within the meaning of the Consumer Protection Act can withdraw from a contract concluded at a distance (or a contract declaration made at a distance) within a period of 7 working days from receipt of the delivery of the ordered goods. It is sufficient to send the declaration of withdrawal within this period, Saturdays do not count as working days.

In the event of withdrawal, a full or partial reimbursement of the purchase price will only take place step by step against the return of the goods received from the customer. The costs of the return are at the expense of the customer.
The goods should be returned in an unused, resalable condition and in the original packaging. In the case of articles that are impaired by signs of use or whose packaging is damaged, we will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when the goods are returned.

Please make sure that your return can be identified, e.g. by enclosing the invoice.

Our offers are non-binding. The contract is only considered concluded when we send a written (by email) order confirmation. During the ordering process you have the opportunity to change the information or correct any errors.

Delivery time:
The dispatch takes place usually within 2 – 7 working days after receipt of order. We strive tohave always everything in stock. However, if something is not available immediately, you will receive a message with the order confirmation, telling you when you can expect delivery.
If we cannot deliver within 2 weeks, you can of course withdraw from your contract.

All prices quoted by us are in euros and include the currently applicable VAT and all other taxes.
VAT is shown separately on the invoice. The prices at the time of the order apply.

We will send the goods to you within 2 days after receipt of payment.
Payments by the customer are only deemed to have been made when they are received on our business account.

Transport damage:
The customer is obliged to check the goods immediately upon receipt and to report any defects and incorrect deliveries immediately after their discovery (no later than 48 hours after receipt of the delivery) by email.
Visible damage to the shipment must be reported to the deliverer immediately, as otherwise this cannot be taken into account.

Retention of title:
The goods remain our property until full payment.

Claims for damages in cases of slight negligence are excluded. This does not apply to personal injury or damage to items taken over for processing, unless the latter has been negotiated in detail.

Product liability:
Any recourse claims that contractual partners or third parties make against us under the title “product liability” within the meaning of the PHG are excluded, unless the person entitled to recourse can prove that the failure was caused in our sphere and was at least grossly negligent.

Apart from those cases in which the right to conversion is due by law, we reserve the right to meet the warranty claim through improvement, replacement or price reduction, as we choose.
The transferee always has to prove that the defect already existed at the time of handover.
The warranty period for our products is 24 months.

Repair service
Even after the purchase, we are committed to you. Many problems can be resolved over the phone. Should a repair be necessary, it will be carried out quickly and professionally.

Place of fulfillment:
The place of performance for both our performance and the consideration is the registered office of our company.
If the private end user does not have a place of residence within the European Union, our place of business is the place of jurisdiction.
In dealings with end consumers within the European Union, the law of the end consumer’s place of residence may also be applicable, provided that it is mandatory consumer law provisions.

Choice of law:

Austrian substantive law is applicable to this contract. If the contractual partner is a consumer and the requirements of Art. 5 Para. 2 of the europ. Obligations Convention (EVÜ) , than does not result, in the case of Art 5 Para 4 in conjunction with Para 5 EVÜ, that the choice of law that the consumer is subject to the mandatory provisions of the law of the state in which he has his habitual residence, granted protection is withdrawn.

Final provision:
If a single clause should be ineffective, the concluded contract remains effective for the rest. An ineffective clause is to be replaced by an effective one that comes closest to the intended regulation.

In the event of differences, we will endeavor to find a quick and customer-friendly solution and transfer the difference to your bank account as quickly as possible.
